SECOND ATTACK AGAINST CESAR AUGUSTO TAMAYO RUIZ,
SON OF PEACE SIGNATORY IN SANTANDER COLOMBIA IN LESS THAN 6 MONTHS,
THE AUTHORITIES DO NOTHING TO PREVENT THESE EVENTS AND NOTHING CHANGES DENOUNCES

The Colombian Rural Association “ASOGRAS COLOMBIA”, we denounce before the authorities,
national and international community and human rights defense organizations.
FACTS
I. We wish to bring to the attention of the national and international community the news facts of violation of human rights and attempted murders, that occurred on February 6, 2022, at approximately 12:40 A.M., a couple of subjects or hired killers (sicarios) who proceeded to shoot on several occasions and break all the windows of the main door of the residence of CESAR AUGUSTO TAMAYO RUIZ, leaving everything destroyed in their path. It is the second time that they attempt against the life and physical integrity of this Asogras member. The man called the 123 line of the National Police and the quadrant of the neighborhood El Carmen of the municipality of Floridablanca, these policemen arrived, looked outside, and said that they could not do anything since this was a sector of invasion, and that it was normal that these facts happened. Cesar Augusto Tamayo Ruiz lives in the transversal oriental Sur Atoque, low house 39th, block 2 of Floridablanca Santander Colombia. This attack was allegedly led by ALIAS CESITAR and JAIRO, who apparently are part of a combo or a criminal structure and who have dominance with drug trafficking issues in the area. Alias Cesitar is called CESAR RAMIREZ PULIDO and Alias Jairo is called JAIRO RAMIREZ PULIDO, who handle drug trafficking issues and justice on their own in the Floridablanca area and other sectors. According to information circulating in the area, many of the community fear them for their criminal actions and because they are the ones who exercise criminal authority without anyone to control or prevent them.
II. This is the second attack suffered by this colleague in less than 6 months, in the same place of his residence. In fact, on August 6, 2021, around 4:00 P.M, he experienced a shooting attack by two assassins who arrived on a motorcycle to his residence, where he had a business selling fast food in the human settlement called Sur Atoque, low house 39th, block 2 of Floridablanca Santander Colombia, where he lives with his family. The authorities are already aware of these facts, and so far there has been no result on the facts of the first attack against him. It should be noted that the father of the victim of the attack, Mr. CESAR AUGUSTO TAMAYO, who stayed in the house when he arrived in the city of Bucaramanga and after the first attack stopped staying in the victim’s house, is a peace signatory of the extinct guerrillas of the FARC-EP, and at the same time is a human rights defender of several social areas. He is in fact President of the Careen Center (C.T.P) of the municipality of Sabana de Torres, President of the Pomca Lebrija Medio, Presidente of the Vereda Doradas Community Action Board (Junta de Acción comunal de la Vereda Doradas) of the municipality of Sabana de Torres, and President of Asogras Colombia, a national rural organization of the Colombian government. It is believed that this may be in retaliation for the work performed by the father of the bombing victim.
III. These facts were already reported to the Attorney General’s Office in the city of Bucaramanga. The number of the criminal reports is NUNC680016000159202201144, presented on Sunday, February 6, 2022, to an official of the Sijin, in the city of Bucaramanga. A complaint was also presented to the regional Ombudsman’s Office in the city of Bucaramanga on the subject of early warnings.
REQUESTS
FIRST: We request the Attorney General’s Office of the Nation, Dr. FRANCISCO BARBOSA, to open a criminal investigation for attempted murder, death threats, the right to peace, and whatever his office determines, for not providing the necessary security guarantees to safeguard the right to life and personal safety of the son of a peace signatory who is committed to the peace process.
SECOND: We request to the Attorney General of the Nation, Dr. MARGARITA CABELLO, that there be a disciplinary investigation for lack of security for the victim, since so far the corresponding security has not been provided, negligence and what her office determines, for not providing the necessary security guarantees to safeguard the right to life and personal safety to the son of a peace signatory, who is committed to the peace process. We request her intervention as public prosecutor to guarantee the fundamental rights to life and the peace process of the signatories.

THE COURT DECLARED AN UNCONSTITUTIONAL STATE OF AFFAIRS (ECI) DUE TO THE LOW LEVEL OF IMPLEMENTATION OF THE COMPONENT OF SECURITY GUARANTEES FOR THE SIGNATORY POPULATION IN TRANSITION TO CIVILIAN LIFE, PROVIDED FOR IN NUMERAL 3.4 OF THE FINAL PEACE AGREEMENT, DEVELOPED BY CONSTITUTIONAL AND LEGAL NORMS.
THIRD: We request the pronouncement and accompaniment of the Human Rights Defense Organizations, the National Ombudsman’s Office, the Office of the High Commissioner for Human Rights of the United Nations, the Office of the High Commissioner for Peace of Colombia, the OAS, the International Commission on Human Rights, the international community, the regional and national international media, and the guarantor countries of the peace process to make a statement to the national government.
FOURTH: We demand the National Protection Unit, the U.N.P. to provide security measures to the victim of the two attacks by providing a strong security scheme consisting of an armored vehicle and two male escorts to guarantee the right to life and personal integrity and the family of this fellow victim, it should be remembered that the National Protection Unit since the month of August 2021 is supposedly doing a security study of the victim and to this day has not delivered the results of this study to the victim of the attack, demonstrating the inability the inoperability, This demonstrates the inability to solve the security problems of the victims of attacks, victims of threats, peace signatories, human rights defenders and all kinds of victims that exist today in Colombia and for which this entity does not give or fulfill the functions for which it was created and less for the peace signatories and their families who today are at total risk to the right to life, it is clear that so far in 2021 there are more than 303 signatories murdered with the approval of the national government of Colombia and in violation of the peace agreement.
